TERMS AND CONDITIONS These Terms and Conditions are incorporated into and made a part of the Rental Agreement entered into between GUEST and J2 PROPERTY MANAGEMENT INC. (hereinafter \`Florida Spirit\`). 1\. Nature of Use. Guest is hereby granted a license to use the Premises. Guest acknowledges and agrees that no form of tenancy has been created pursuant to Chapter 83, Florida Statutes through Guest\`s use of the Premises. 2\. Age Requirement. Guests under the age of 18 unaccompanied by a parent or legal guardian will not be permitted to rent or occupy any vacation rental home from Florida Spirit. Any reservations made under false pretenses will result in loss of advance payments and removal from the premises. 3\. Agency of Florida Spirit. Guest acknowledges and agrees that Florida Spirit acts as agent on behalf of the owner of the subject vacation property (the \`Premises\`) for the purpose of reserving, renting and managing the use of the Premises. 4\. Prohibited Uses. Only Guest and persons identified in the Rental Agreement as a Guest party may use or occupy any part of the Premises. Guests may not invite other persons to make use of the Premises or the amenities related to such Premises for any reason whatsoever. Smoking is not permitted in any part of the Premises. Failure to comply with Florida Spirit’s non-smoking policy will result in a $75 charge to the credit card on file. Grills should only be used on the lawn outside of the pool screen, and not inside any other part of the Premises including, without limitation, inside the house, in the garage, or on the pool deck. Guests are solely responsible for using appropriate safety precautions in using grills on the Premises, and shall be liable for all damage resulting from misuse of any grill. Parents are solely responsible for supervising their children on the Premises, including the pool, if applicable. Adult supervision is required at all times when children are using the pool. Renters must be 18 years of age and hold a major credit card (not debit card) in their name. 5\. Pets. Guest acknowledges that NO PETS or animals of any nature are permitted on the Premises, unless the reservation and Florida Spirit has expressly authorized such use. Some homes are Pet Friendly (DOGS ONLY, maximum 2) and require a non-refundable Pet Fee of $150.00 and $250 Refundable Pet Deposit that is refunded after departure if there are no damages caused from the pet. If pets or animals are found to be occupying the Premises without authorization, Guest will be subject to all other rights and remedies of Florida Spirit for violation of these Terms and Conditions, and in addition a $500 cleaning fee will be charged to the credit card on file. 6\. Check In/Check Out. Check in at the home is after 4:00 p.m. and check out from the home is before 10:00 a.m. Use last four digits of booking number to access your home during your stay dates. Guest may proceed directly to the Premises for check in. Guests are requested to lock the home behind them on day of departure. Failure to depart by 10:00 am may result in a $75.00 charge to the credit card on file. 7\. Right to Refuse Occupancy and Removal of Guest. If Guest violates the terms and conditions of occupancy of the Premises, including without limitation, failure to pay rent as agreed with Florida Spirit, failure to check out of the Premises at the time set forth herein (or if such time is extended at Florida Spirit\`s sole option, at the time otherwise agreed to by Guest and Florida Spirit in writing), causing damage to the Premises, or engaging in prohibited use of the Premises, and Guest fails to pay for, or vacate the Premises upon written or oral request by Florida Spirit, Guest may be summarily removed with the assistance of a Florida law enforcement officer in compliance with Section 509.141(4), Florida Statutes. In addition, in the case of a large unpaid bill for rental of the Premises where Florida Spirit reasonably determines that such an unpaid bill may not be paid by Guest, Florida Spirit may elect, in addition to all other remedies available to Florida Spirit, to lock Guest out of the Premises until payment arrangements are made in accordance with Section 509.401, Florida Statutes. In the event a guest fails to depart from the home on time at 10:00 am, forcing Florida Spirit not to be able to clean and prepare the home for the next arriving guest that day and having to move that guest to another home, the departing guest agrees to pay damages and cost incurred by Florida Spirit. Florida Spirit reserves the right to refuse service to any guest for any reason, provided, however, that such refusal shall not be based on race, creed, color, sex, physical disability or national origin. 8\. Comparable Premises and Force Majeure. Unforeseeable circumstances may arise which make it impossible or impractical for Florida Spirit to provide the anticipated accommodations to Guest. Such circumstances may include, but not be limited to, scheduling problems, equipment failure, as well as a fire or other casualty at the Premises. In such a circumstance, Florida Spirit reserves the right to transfer Guest to another vacation property of reasonably comparable value, determined in the sole discretion of Florida Spirit, whose determination shall be final. In other circumstances such as acts of God, acts of war, acts of terrorism, hurricanes, wind storms, fires or other natural occurrences, said circumstances not being exclusive, it may be impossible or impractical for Florida Spirit to make available reasonable or other alternative accommodations to Guest. In such a circumstance, Florida Spirit shall return 100% of the payments received by Guest. 9\. Furnishing and Linens. Furnishings of the Premises are subject to change without notice. Furniture, bedding, utensils or any other property supplied with the Premises must not be taken out or transferred from one property or another. Loss of these items, as well as damage to the property or furnishings in excess of normal wear will be charged to the Guest. Moving of furnishing inside, outside, or in the game room of the Premises is strictly forbidden. If any furnishings need to be moved back to original placement, there is a $125.00 per hour charge to the Guest. A basic supply of linens is provided in each property. Bed linen and bath towels are not changed during your stay. The startup kit of hand soap, toilet tissue, paper towels, laundry soap, dish soap and trash bags are not replenished. 10\. Cleaning. Each reservation includes a home cleaning fee. Daily housekeeping is not provided and it is the responsibility of the guest to maintain the cleanliness of the home during the term of a stay. At the end of a guest’s stay the home will be cleaned by a professional cleaning staff. This will include washing bed linens, towels, and dishes, as well as vacuuming and sanitizing the kitchen, bathrooms, living room, and bedrooms. While the home will be cleaned after a guest departure, guests are required to leave the home in a comparable condition as it was found and guests are responsible for picking up and bagging all trash in the home; failure to do so will result in an additional clean fee charged to the guest. 11\. We booked for the week of xmas to new years. Location was close to all our shopping needs, and there were several food options close by. The house itself was exactly how it's described in the listing. The service company was amazing in it's response to any issues. We had a problem with the pool safety buzzer on the sliding doors malfunction in the late evening 9-10pm, and they had a repair person come by within 30mins. Location was good close enough for everything yet far enough to be out of the insanity of the Disney area. House was perfect for our family. We did have a problem with the hot tub. It was not functioning and they did someone out to look at it. Still didn’t work, but having the clubhouse close by with a hot tub was convenient. They were quick to refund the money so we were satisfied with that. It was unfortunate and left my family a little disappointed with it but overall we had a great time. ##### Orahanh K. Reviewer Comments: The house was comfortable and everything worked as expected. We have rented through VRBO for years with our family and this was the first time we ever experienced a towel shortage. (2) small white hotel style towels are provided per guest...that's it. Every other house we've ever rented had PLENTY of towels. They are cheap, stock up people. Luckily my mom checked in and we came a few days later, so we put extra in our suitcases...but that's a bummer to have to do. ##### Kimberli T. Reviewer Comments: A brilliant family holiday was had here at this house. It was central to the shops Walmart and Publix were within an easy 10 min drive. All disney parks were reached within half hour some are closer, and so easy to get to down the 192\. The house was clean very well presented, full kitchen utilities including dishwasher, fridge freezer, cooker microwave. All found exactly like the advertised pictures on Florida Spirit website.Florida spirit’s detailed instructions on entry including gate number and house entry were perfect. We had to contact them due to a faulty kettle switch and within hours they had arrived with a brand new one, asking if everything else was ok and to contact with any issues. I can appreciate that we were up in the morning and out at the parks early and late home, but even so we did manage a couple of pool days and enjoyed some pool floats and noodles that were in the garage. For younger guests there’s pushchairs/strollers for you to use which was a nice addition, iron/ironing board. Plenty of local shops in the area, including a British pub just outside the gates. Like I said we mainly did Disney and the house was perfect as a base. Can recommend this home as a consideration if planning your holidays ##### Dan M. Reviewer Comments: This was a very disappointing stay, perfect example of false advertisement, and the worst Airbnb/VRBO I’ve ever stayed at. Our biggest issue was the pool. We paid $20 per day extra for the heated pool option and the pool was NEVER even like warm. We brought it to the hosts attention the very first day since one of the days there we were going to have a pool day. Not only did they not do anything to help, but instead claimed that because it was cold outside the pool could not get hot. We literally booked this place for the heated pool as it was advertised and paid extra because we knew the weather was going to be cold. Having a pool of my own and living in SW FL I know that you set the temperature and the pool heats to that set temperature. We couldn’t even go in the pool it was so cold. We also booked this VRBO because it advertised it was within 5 miles from Disney. Again false advertisement. It was 40 minutes to Disney which cost more than we were expecting. They did the bare minimum - No extra shower towels, no pool towels. No extra TOILET PAPER. We only had one roll for 3 nights and 4 days. We ran out and had to use Kleenex from the gas station. The place is DIRTY with very out-dated furniture. A layer of dust on everything including the air vents, the lamps, the blinds and even the walls. I would not recommend a stay here, especially if you’re in Orlando for the parks. ##### Lisa H. I contacted Florida Spirit right away and they offered to send someone, to which we declined as the two items did not affect our stay. They did say they’d send someone upon our departure which was satisfactory to us. It does seem like the carpet could use a cleaning throughout the whole home and while there were certainly kitchen and bath items provided, there was nothing “above and beyond” as we’ve experienced at other vacation rentals of similar price levels. ##### Sarah K. The Kitchen had everything we needed to make our meals. Bonus was heated pool it was great and the hot tub after walking miles daily at the parks was a great way to end the day! Whomever was on-call the first night, did not answer their phone, which would have been maddening had the issue with the lock not ‘resolved’ itself. I was contacted the next morning by the manger, and everything seemed to be in order. When we left the following morning, the lock did not work. One call later and the office had the lock replaced (or possibly repaired).
