Other Things to Note:
The following terms and conditions are hereby incorporated in and made part of the
Rental Agreement for the real property including its grounds known as 340 Kanan Road
Malibu California 90265 (“Premises”) :
1. Personal Lodging: The Premises is for the sole use as temporary personal lodging
by the Rental Guest. Family and guests are permitted provided they are identified
as Authorized Guests at paragraph 4 of the Rental Agreement and have been
informed of and agree to these rules for the Premises.
2. Prohibited Activities: The following activities are expressly prohibited in, on or
about the Premises unless advanced written consent of Owner is obtained, which
consent may be given or withheld in the sole discretion of Owner: (i) Large parties
or gatherings of more guests than contracted; (ii) events of any kind including
without limitation receptions, weddings or parties, (iii) commercial use or
weddings; (iv) filming or photoshoots of or at the Premises in connection with
print adds, television, commercials, movies, internet videos, social media or photo
campaigns; (v) any business activity from the Premises; (v) no drone use for the
purpose of filming or photographing the Premises without written approval from
Owner; (vi) no social media/tags/mentions/geotags that depict Malibu Rocky Oaks
property without written Owner approval. Rental Guest agrees not to post
suggestive or body revealing pictures/video that also depict any part of the
property/grounds of Malibu Rocky Oaks. If requested by Owner, Rental Guest
agrees to use best efforts to take down any photograph or video depicting Malibu
Rocky Oaks from social media or the world wide web.
3. Vendors: Any and all Vendors coming onto the Premises must be approved by
Owner, which approval may be given or withheld in the sole discretion of Owner.
Vendors shall be broadly interpreted as anyone providing a service to the Rental
Guest on the Premises including without limitation caterers, musicians or cleaning
personnel. Vendors must be properly licensed and insured.
4. No Promotional Use: The Premises cannot be used for promotional use nor can
the Rental Guest use in anyway the Malibu Rocky Oaks brand for promotional or
cross-promotional purposes without owner approval.
5. Helicopter: There can be no helicopter landings unless approved by Owner in the
Rental Agreement. If helicopter use is approved by Owner, then the Rental Guest
shall obtain all necessary permits and insurance for such use.
6. Compliance: Rental Guest and any of their guests shall abide by the rules and
restrictions set forth in the Renal Agreement, this Addendum, all State of
California and City of Los Angeles laws and ordinances and any rules and
regulations of any government agency therein. Specifically Rental Guests must
comply with all Covid19 California of State Executive Order and County of Los
Angeles Public Health Officer’s Order see
7. Furnishings: Furnishings of the Premises must remain at the Premises and can
only be used for their ordinary purpose and Rental Guest is responsible for full
replacement for any damages beyond normal wear and tear or their loss. No
attaching or drilling into any part of fundamental existing structures. No taping
(other than owner provided non-stick painters type tape) to floors or any walls or
surfaces. See paragraph 7 of the Rental Agreement.
8. Pool: Grounds of the Premises including the Pool may be used and enjoyed by the
Rental Guest at the Rental Guests’ full responsibility and assumption of the risk.
There is no lifeguard on duty at the pool and Rental Guest assumes
responsibility to monitor. As part of the Rental Agreement, the Rental Guest
agrees to execute the Pool, Hot Tub and Spa Addendum. Neither the Owner nor
Owner’s agents can assure the safety of persons using the Premises containing a
pool, hot tub or spa. As a consequence, Rental Guest assumes liability for pool,
hot tub or spa and any of the Grounds of the Premises used by themselves, other
occupants, their guests or their pets. There can be no glassware within 10 feet of
the perimeter of the pool. Any broken glass in pool will require pool to be drained.
Pool heater/features/settings and controller to be adjusted by site rep/Owner only.
09. Pets: Rental Guest or their guests are not permitted to bring Pets onto the Premises
unless approved by Owner in the Rental Agreement, which approval may be given
or withheld in the sole discretion of Owner. Local wildlife can impose danger to
pets, please use caution.
10. Clean Condition: Rental Guest shall maintain the Premises and its furnishings in
good and clean condition including without limitation maintaining a clean stove,
refrigerator, shower and sinks/basins. Please avoid making any loud noise or
nuisance after 10pm. Reports of excessive notice or unruly behavior is grounds to
terminate the Rental Agreement and remove the Rental Guest from the Premises.
11. Insurance/Valuables: Rental Guest prior to taking possession of the Premises
shall obtain and provide Owner with written verification of insurance to protect
Occupant, guests and licensees and their personal property from any loss or
damage. See paragraph 24 of Rental Agreement.
12. No smoking / Pyrotechnics: Not allowed indoors. Not allowed outdoors either
during any high wind / red flag or fire watch / warnings.
13. Bathrooms: Please do not flush any foreign objects down toilets and use owner
supplied toilet paper.
14. Site Rep: Owner has a designated representative who will be available at all times
to handle any complaints, ensure enforcement of the Owner’s House Rules and
comply with any health and covid-19 directives. The representative shall not
intrude on the privacy of the guests.
