This document governs the use by you, the customer, of the Expedia Desktop Gadget ("Gadget"). By installing, copying or otherwise using the Gadget, you acknowledge and agree that:

• your use of the Gadget shall be governed by the "Expedia Inc. Web Site - Terms Conditions and Notices" (the "Terms of Use"), which can be found at http://www.expedia.co.uk/daily/service/legal.asp ;
• the Gadget consists of software developed by or on behalf of Expedia's supplier, Microsoft Corporation, a Washington corporation located at One Microsoft Way, Redmond, WA 98052-6399 and elements developed by Expedia Inc. to work in conjunction with Microsoft's software;
• in particular the limited licence set out in the "Software available on this web site" section of the Terms of Use shall apply to your use of the Gadget; and
• in construing the Terms of Use, the Gadget is to be regarded as software published on and/or contained on and/or obtained and/or made available through the Expedia Inc. Web site.
• in construing the Terms of Use, the Gadget is to be regarded as "Software".

In addition and subject to the various terms and conditions referred to above, please also note that

• the Gadget only functions on the following operating systems: Microsoft Windows Vista® or Microsoft Windows 7©.
• if you enter personally identifiable information ("PII") into the Gadget this PII is not collected, viewed or otherwise used in any way or for any purpose by Expedia, its affiliates and/or their suppliers. All other PII you provide to Expedia through the Web site is governed by the "Expedia.co.uk Privacy Pledge" which can be found at http://www.expedia.co.uk/daily/service/privacy.asp.
